PRIVACY POLICY

This privacy policy describes how the Zyllem.com website (the “Platform”, “we” or “us”) collects, uses, shares and protects the Personal Data that we collect through this Platform. Zyllem has established this Platform to link up users who need something shipped or delivered (“Clients”) with individuals and/or transportation companies that can provide the shipping and delivery services (“Couriers”). This policy also applies to any mobile applications that we develop for use with our services, and references to this “Platform”, “we” or “us” is intended to also include these mobile applications. Please read below to learn more about our information practices. By using this Platform, you agree to these practices.

1.  DEFINITIONS

1.1.    “Client” refers to a business entity or individual seeking delivery services via the Platform. Also a collective term for Senders and Recipients.

1.2.    “Sender” refers to a person and/or entity who makes a Delivery Request by inputting the Delivery Information onto the Platform and pays Zyllem for the Delivery Request.

1.3.     “Recipient” refers to a person and/or entity whose name and details are provided by the Sender as the person and/or entity who the Parcel shall be delivered to.   

1.4.     “Courier” refers to an individual or a local transportation firm who signs up with Zyllem via the Platform as independent contractors of Zyllem for the purposes of providing the Delivery Services.

1.5.    “Delivery Request” refers to the request for the delivery one or more Parcels and Items requested by the Client to be collected from one address (Pickup Point) and delivered to another address (Delivery Point). When there are multiple Pickup and/or Delivery Points, we will consider them as multiple Delivery Requests.

1.6.    “Completion of Delivery Procedures” refers to one of the methods in which a delivery can be completed. This method requires the Recipient or person receiving the Parcel on behalf of the Recipient to provide his/her name and signature.

1.7.    “Enhanced Completion of Delivery Procedures” refers to one of the methods in which a delivery can be completed. This method requires the Recipient or person receiving the Parcel on behalf of the Recipient to do any or all of the following, as indicated on the Delivery Request:

i.   “Photosign” - requires the Recipient or person receiving the Parcel on behalf of the Recipient to take a photograph of himself/herself on the spot, and sign on the photograph;

ii.   “Collection of Photo ID” - requires a photo to be taken of the Photo ID of the Recipient or person receiving the Parcel on behalf of the Recipient; and/or

iii.  “Collection of Delivery Order” - requires a photo to be taken of the Delivery Order.

1.8.   “Delivery Services” means all the services that we, directly or indirectly, provide to the Clients in relation to the delivery of the Parcel or Items.

1.9.   “Parcel” refers to an Item or collection of Items wrapped in paper or inside any other container in order to be transported by Zyllem’s Couriers.

1.10.  “Item” refers to each individual object inside a Parcel. A Parcel might include multiple Items, and a Delivery Request might include multiple Parcels.

1.11.  “Platform” refers to all website, mobile apps or any other products or software provided by Zyllem from time to time.

1.12.  “Personal Data” refers to any data about an individual who can be identified from that data or from that data and other information to which we have or are likely to have access, including data in our records as may be updated from time to time. The Personal Data we collect from you include, but not limited to, your name, identification card number, passport number, race, gender, date of birth, photograph, telephone number, fax number, mailing and/or billing address, email address, resident status, education background, financial background, your occupation, the industry which you work in, third-party account credentials (for example, your log-in credentials for Facebook or other third party Platforms) and any other information relating to any individual provided to us.

2.  DATA COLLECTED DIRECTLY FROM YOU

2.1.  Personal Data that you provide

If you want to make a Delivery Request, bid on a Delivery Request, or contact a Zyllem member, you must create an account on our Platform and provide us with all the required Personal Data in order for us to process your account and/or Delivery Request. You may also provide us with information other than the basic information that we need to establish your account. It will be up to you to decide how much information to share as part of your profile. We encourage you to think carefully about the information that you share and we recommend that you guard your identity and your sensitive information. Of course, you can review and revise your profile at any time.

In addition to the Personal Data that you provide to us directly via the Platform, we may collect your Personal Data from a variety of sources, including but not limited to, the following:

  • Personal Data that you provide to our Customer Service, Couriers, agents or affiliates via phone call, text messages and/or e-mails;

  • If you follow or like our social media pages;

  • When you interact and communicate with us at our events or activities; or

  • When you enter contests or promotional activities organized by us, our sponsors or advertisers.

2.2.  Payment Information

We do not collect or store your payment information. Instead, we use PayPal to process all payments for services provided through this Platform. Thus, if you are a Client, you will make payments using PayPal; and if you are a Courier, you will receive your compensation payments through a verified account that you establish with PayPal. The payment information that you provide will be collected and stored by PayPal subject to its privacy policy and terms of use. For more information, visit PayPal at www.paypal.com.

2.3.  Facebook Connect

We may offer you the opportunity to log in to our Platform using Facebook Connect. This service will authenticate your identity and provide you the option to share certain Personal Data with us such as your name, email address, and picture to pre-populate your profile. Facebook Connect gives you the option to post information about your activities on the Platform to your profile page to share with others within your network.

2.4.  Information about others

If you are a Client planning to ship something using the Zyllem service, we will ask you for Personal Data about the Recipient of the shipment. By providing us with the Recipient’s Personal Data, you acknowledge that you have obtained the Recipient’s consent to provide us with such information for the purposes of engaging our Delivery Services. Kindly note that we may collect the Personal Data of the Recipient and/or persons acting on behalf of the Recipient as may be required under the Completion of Delivery Procedures and/or Enhanced Completion of Delivery Procedures. We may store these collected Personal Data for as long as it is necessary for our purposes and as permitted by applicable law.

3.  DATA COLLECTED BY AUTOMATED MEANS

3.1.  Information provided by your web browser

You do not need to provide us with any Personal Data if you simply want to browse through the Platform and learn more about our services. Like many other websites, we may record information that your web browser routinely shares, such as your browser type, browser language, software and hardware attributes, the date and time of your visit, the web page from which you came, your Internet Protocol address and the geographic location associated with that address, the pages on this Platform that you visit and the time you spent on those pages. This will generally be anonymous data that we collect on an aggregate basis. We may also use Google Analytics or a similar service to gather statistical information about the visitors to this Platform and how they use the Platform. This, also, is done on an anonymous basis. 3.2.  Session and Persistent Cookies

As is commonly done on websites, we may use cookies and similar technology to keep track of our users and the services they have elected. A “cookie” is a small text file containing alphanumeric characters that is stored on your computer’s hard drive and uniquely identifies your browser. We use both “session” and “persistent” cookies. Session cookies are deleted after you leave our Platform and when you close your browser. We use data collected with session cookies to enable certain features on our Platform, to help us understand how users interact with our Platform, and to monitor at an aggregate level Platform usage and web traffic routing.

If you have created an account, we will also use persistent cookies that remain on your computer’s hard-drive between visits, so that when you return to our Platform we can remember who you are and your preferences. For example, after you log out of our Platform, these persistent cookies can enable you to return to our Platform without the need to log back in.

We may allow business partners who provide services to our Platform to place cookies on your computer that assist us in analyzing usage data. We do not allow these business partners to collect your Personal Data from our Platform except as may be necessary for the services that they provide.

You can manage these cookies. For example, you can configure your browser to accept all cookies, reject all cookies, or notify you when a cookie is set. If you disable cookies, however, it may interfere with the functionality of our Platform and you may not be able to use all of the Platform’s features.

3.3.  Web Beacons

We may also use web beacons or similar technology to help us track the effectiveness of our communications. For example, if you have elected to receive any of our e-mail newsletters, we may use technology that allows us to see how many recipients have opened the message and how many have clicked on one of its links.

3.4.  Advertising Cookies

We may use third parties, such as Google, to serve ads about our Platform over the internet. These third parties may use cookies to identify ads that may be relevant to your interest (for example, based on your recent visit to our webPlatform), to limit the number of times that you see an ad, and to measure the effectiveness of the ads. You can disable these advertising cookies by opting out at Google.

4.  PURPOSES OF COLLECTING PERSONAL DATA

4.1.  We may use and process your Personal Data to provide you with our Delivery Services, including but not limited to, the following purposes (where applicable):

For Clients:

  • to provide you with our Delivery Services that you have requested, including but not limited to, processing and managing your Delivery Request, facilitating the delivery of your Parcel, notifying you regarding the status of your delivery, contacting you on any issues that arise during the delivery of the Parcel;

  • to validate the details in your Delivery Request and process payments relating to the Delivery Request that you made;

  • to process, manage or verify your application to register as a user on our Platform, and to provide you with the benefits that are offered to registered users;

  • to process your participation in any events, activities, promotions, contests, polls or surveys organised by us or our sponsors/advertisers;

  • to provide you with any services you have requested;

  • where you have downloaded our mobile app, to process your request and deliver the app to you and provide you with a license for the use of the app;

  • to provide you with post-delivery services;

  • to contact you for feedback after the completion of a Delivery Request; and

  • to resolve any problems or disputes you may encounter in relation to our Delivery Services;

For Couriers:

  • to process, manage, evaluate and/or verify your application to register as one of our Couriers;

  • to allow you to provide Delivery Services to our Clients;

  • to process payments relating to the Delivery Requests which you have completed; and

  • to contact you.

4.2.  We may also use your Personal Data for purposes connected or relevant to our business, including but not limited to, the following (where applicable):

  • to monitor and analyse visitor activity on our Platform;

  • to develop a knowledge base regarding our Platform users;

  • enforcing obligations owed to us;

  • complying with legal and regulatory obligations and requirements;

  • carrying out research, planning and statistical analysis; and

  • staff training.

4.3.  If you consent to us using your Personal Data for marketing and promotional purposes, we may use and process your Personal Data in the following manners: -

  • to send you our promotional materials, updates and newsletters; and

  • to notify and invite you to events organised by us, our sponsors or advertisers;
     

5.  USE AND DISCLOSURE OF PERSONAL DATA

5.1.  Registered Zyllem users

When you register on our Platform, you will create a user name and profile. Your user name and profile will be accessible by other registered users of our Platform. With your prior permission, we may also share information about your use of the service on third party Platforms. For example, we may allow you to elect to share information about the services we provide through this Platform as updates to your Facebook or Twitter accounts.

If you post a Delivery Request as a Client, we will publish the address of the Pickup Point and Delivery Point on the Platform, viewable by all Zyllem Couriers. If you enter into a confirmed transaction on our Platform with another user (that is, you, as a Client, accept a bid from a Courier; or you, as a Courier have a bid that is accepted by a Client), you will have access to the other user’s Personal Data, and that user will have access to your Personal Data. Note that other users will never have access to your billing information.

If you are a Courier seeking information on available Delivery Requests, we may use information that you or your browser provides to display available Delivery Requests in your area. This may be based on your zip code, on the geographic location indicated by your IP address, or by address information that you voluntarily provide to us for this purpose.

5.2.  Your contact information

When you provide us with your contact information, we will use that information to communicate with you about your use of our Delivery services. For example, when you have entered into a confirmed transaction with another user, we will use your contact information to notify you of the transaction. We may also share your contact information with the other user (and the other user’s contact information with you) so that you may contact each other about the transaction. If you agree, we may also use your e-mail address to send you a newsletter or other information about our services or about other products or services in which you may be interested.

We also have a “contact member” feature that allows users of our Platform to communicate with Zyllem members. With this feature, you can create a message and we will send it on your behalf to a list of e-mail messages that you supply. We will only use the e-mail messages for purposes of sending the message. If you use this feature, you agree to use this only in connection with services offered through Zyllem.

5.3.  Testimonials

We may allow you to submit testimonials about your experience with our Platform. If you provide a testimonial, we may post it on the Platform along with your name. If you want your testimonial removed, please contact us at info@zyllem.com.

5.4.  Ratings and Reviews

If you are a Client, you will be able to rate and review a Courier who provides services to you. If you choose to submit a rating, this will be aggregated with other ratings and available to other registered users of the Platform. If you submit a review, your review along with your user name will be posted for everyone to see.

5.5.  Shipment Recipients and referrals

We may provide an e-mail service and text messaging service for alerting Recipients that a shipment is on its way through the Zyllem service. If you elect to provide us with an e-mail address or mobile phone number of the person or organization receiving your shipment, we will send the Recipient a notification message of the shipment and the expected delivery time frame.

We may also provide you with the opportunity to refer a potential Client to our Zyllem services and earn a commission on the referral. To take advantage of this opportunity, you will need to provide Zyllem with the e-mail address of the potential Client. By providing us with the information of the potential Client, you agree that you have obtained his/her consent to provide us with such information for the purposes of receiving our promotional messages. We will include your name in the promotional message that we send the potential Client, but will always give the potential Client the option to decline any future promotional messages. Of course, we will not share the contact information of the Recipient or potential Client with other companies for their marketing purposes.

5.6.  Information shared with our business partners

We may use business partners to help us design and operate our Platform and provide services to support the Platform. For example, we use PayPal to collect and process all payment information. We may also hire a company to run certain website applications, provide data storage and processing services, or help us analyze our data. These business partners may have access to the Personal Data that we keep, but only to the extent that is necessary for their performances of these tasks on our behalf. We do not allow these business partners to make any independent commercial use of the Personal Data that we store, to share such data with third parties or from making the data publicly available. Keep in mind, however, that if you establish a separate relationship with one of these business partners (for example, if you establish an account with PayPal), the information you provide directly to that organization will be subject to its terms of use and its privacy practices.

Third party vendors, including Google, use cookies to serve ads based on a user’s prior visits to Zyllem. You can disable these specific cookies that track prior visits for the sake of follow-up advertising by opting out at Google.

5.7.  Business operations, law enforcement and legal actions

We may release your information without prior notice when we believe it is appropriate to prevent fraud or to prevent or stop activity that we know or suspect may be illegal, unethical or legally actionable; to comply with law or to cooperate with law enforcement activity or other governmental request; to respond to subpoenas, court orders or administrative agency requests for information; to enforce our policies; to protect the rights, property and safety of our business and of others; or when otherwise required by law. If there is a sale or merger of the company, division or business unit that operates this Platform, we may also transfer the information we have collected in connection with such sale or merger.

6.  THIRD PARTY WEBSITES

This Platform may contain links to other websites operated by companies that are not affiliated with us. Also, you may have come to this Platform from a website that is not operated by us. We are not responsible for the operation of these other websites or the information that they collect from their visitors. 7.  ACCESS AND CORRECTION OF PERSONAL DATA

7.1.  If you have any complaint or correction to be made in relation to the collection, use, and /or disclosure of your Personal Data, please notify our Data Protection Officer. The contact details of our Data Protection Officer are:- dataprotectionofficer@zyllem.com. (hereinafter known as the ‘Data Protection Officer’).

7.2.  The Data Protection Officer will respond to requests made by you to correct any error or omission in your Personal Data as soon as practicable. The corrected Personal Data will be forwarded to every other organisation to which the Personal Data was disclosed to within a year before the date the correction was made, unless that other organisation does not need the corrected Personal Data for any legal or business purpose.

7.3.  Should you wish to know how your Personal Data is being used by us, please send the Data Protection Officer a request (the “Access Request”) and you will be provided with the following information:

  • Personal Data about you that is in our possession or under our control; and/or

  • information about the ways in which your Personal Data have been or may have been used or disclosed by us within a year before the Access Request.

7.4.  To make an Access Request, please contact the Data Protection Officer and kindly include your name and identification particulars and such information that we may require to identify you and the relevant Personal Data.  Please be informed that we are entitled to charge a fee to recover the costs directly related to the Access Request for the time and effort spent by us in responding to your Access Request, and will let you know the amount accordingly. 

7.5.  We will not entertain any trivial, frivolous or vexatious requests, or any other unreasonable requests of which the burden or expense of providing access would be unreasonable to us or disproportionate to our services.

8.    PROTECTION OF PERSONAL DATA

We use commercially reasonable means to protect the integrity of our Platform and limit access to your Personal Data by third parties. We also limit the amount of information that we collect to the information we believe is minimally necessary for us to provide our service. We do not collect or store your payment information, but instead rely upon PayPal and its secure infrastructure to process payment for confirmed transactions. PayPal encrypts information using secure socket layer (SSL) technology. Of course, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee its absolute security and we will not be liable for breaches of confidentiality due to system failures or unauthorized access by third parties.

If you have registered on this Platform, you should be sure to protect your user ID and password to prevent others from being able to access the Platform in your name. You should also be on guard for “phishing” scams and similar types of identity theft schemes. We do not and will not, at any time, request your credit card information, your account ID, login password, or national identification numbers in a non-secure or unsolicited e-mail or telephone communication.
If there is a breach of security involving your personal data that requires notification, you agree that we may notify you about the breach via email or by a conspicuous posting on this Platform. We will make the notification without unreasonable delay, consistent with the legitimate needs of law enforcement and any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.

9.    DATA INTEGRITY AND RETENTION

We use the information that we collect about you only for the purposes for which it is collected and consistent with this policy. We keep information provided to us for as long as we believe necessary for our business purposes and as permitted by applicable law.

10.  WITHDRAWAL OF CONSENT

By voluntarily providing your Personal Data to us, you are deemed to have consented to the collection, use and disclosure of your Personal Data as stated in this Privacy Policy. Should you wish to withdraw your consent for the purposes stated under Clause 4.3 (marketing purposes), you may do so by sending us a notice ("Withdrawal Notice") to the Data Protection Officer, stating your name and identification number, and the purpose(s) that you had previously consented to for which you wish to now withdraw your consent for. You may also click on any “UNSUB” link that is embedded in the relevant email or text messages to withdraw your consent, if appropriate.

Please note that if you withdraw your consent for the purposes stated under Clauses 4.1 and 4.2, our ability to provide you with our Delivery Services will be affected. Withdrawing such consent may necessarily prevent us from providing our Delivery Services to you.

11.  CHILDREN

We will not knowingly collect or solicit Personal Data from anyone under the age of 13 or knowingly allow such persons to register. If you are under 13, please do not attempt to register on the Platform or send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 shall provide Personal Data to us or on the Platform. In the event that we learn that we have collected Personal Data from a child under age 13 without verification of parental consent, we will delete the information as quickly as possible. If you believe that we might have any information from or about a child under 13, please contact us at info@zyllem.com.

12.  CHANGES TO THIS POLICY

Our business and the laws that regulate us change from time to time, and we reserve the right to change this policy. If we do change this policy, we will post the revised version on this Platform. If we propose to change our policy in a way that would permit us to make additional uses of Personal Data that we had previously collected about you, we will provide you with a meaningful way to opt out of those additional uses.

13.  GOVERNING LAW

This Privacy Policy shall be governed in all aspects by the laws of Singapore. You agree to submit to the exclusive jurisdiction of the Courts of Singapore in any dispute relating to this policy.
